    -LIABILITY TO COMPENSATE FOR DAMAGE OUTSIDE CONTRACT DUE TO CAUSE ENVIRONMENTAL POLLUTION.
    I. Definition of environment : nature elements and artificial material factors relate tightly with each other. Surround human being. (Jurisprudence dictionary)
    1. Environment comprising: land, water, air, sound, light, residential areas, production areas, historical monuments…
    2. Environment classification: two kinds, that are nature environment and artificial material Environment
    3. Environmental pollution:
    -biology: this definition means that environmental conditions in which chemistry and physics indices have been changed badly.
    -Legal definition: environmental pollution is changes of ingredient Environments which are not suitable with environmental standards, cause bad affection to human being and creatures. (clause 6, article 3, environmental safeguarding law)
    -The common thing of those two definitions is: the changes of ingredient Environments to worse trend, cause disadvantages to people and creatures.
    -environmental pollution mainly cause by pollution causing chemicals such as CFC, CO, dioxin…
    II. CONDITIONS TO ARISE COMPENSATION LIABILITY:
    1. DAMAGES HAVE TO HAPPEN:
    -DAMAGE DEFINITION: look up jurisprudence dictionary…
    -Requirements of damage: damages have to be practical …
    -Damage classification: physical Damages and spiritual Damages.
    2. THERE ARE ILLEGAL ACTS:
    illegal acts are specific conducts of human being, it is expressed through action or without action, contrary to provisions of law, infringe upon legitimate rights and interests of other subjects which are recognized and protected by law
    conducts cause damages but not considered illegal conducts:
    +legitimate self-defense
    +the requirements of emergency circumstances
    + force majeure event (unless otherwise provided for by law)
    +Damages due to fault of victim
    3. FAULT:
    Persons who cause damage only have to compensate when they have fault.
    Faults are one’s psychological states and degrees of awareness to one’s conducts and consequences of those conducts.
    There is no fault if one comply with all requirements of law
    4. CAUSAL RELATIONSHIP BETWEEN ILLEGAL ACT AND DAMAGE:
    It must have causal relationship between illegal act and damage. Happening damage have to be indispensable consequences of illegal acts and illegal acts have to be causations which cause damages.

We probably take the topic to discuss about. the problems as the exercises we did at school wil be done here, but in E. Everyone will do by own and then show the way. we will discuss about and find the final result. We will be pracised not only E but also the way how to solve a legal problem in E. That is also the purpose when we join this 4rum i think. The teacher will give the final opinion.     I want to tell you that no matter how topic you are , you are right in partial , because I can see your point through questions which contain writer’s mean.

    Everybody has a specialize ability togetther his way which was chosen by himself and he always fulls his background for his way to the success.

    I think a writer who could haven’t total lack background in some areas, too. They can have opposite wiev over anything, but they would render another oppinion instead argument and select its then?

    However ,this matter is different from a writer without ability to clear writing which wasn’t makes the clien to believes him.

    Are you agree me ? My English still bad , I have you take my English to progress !

    First of all, I agree with you that making a forceful point would depend on ability of each writer. However, herein the topic, I intended to emphasize how a clear writing document is regardless of its writer.

    I don’t really get your message regarding the sentence of “if it gap the basic , you can’t persuade anyone”. Do you mean a writer who is lack of background in some areas or something like that?

    I agreed you that clear writing would make legal documents precise which can protect the client , who feel of please to . Seeing that it mirror lawyer image, but I don’t think it allow me make a forceful point in which contain the specialize ability of one. if it gap the basic , you can’t persuade anyone.

  45. It’s interesting when access this page. Mai Nguyen idea as well as Mr Hung and Hoa are clear. Let’s do it. How about if we devide English for law into parts as law field: English for Business law, E for Civil Law, E for Criminal law… and each topic should have a admin or chair… It’s should be like a 4rum. However, I doubt this web useful for the kind of activities 🙁 but try to do it.

    Truthfully, I hope that this column will be more interesting and well-organized day by day.
    Here are some ideas to organize this column and help it work efficiently:
    – Firstly, I think we should have a chair-man to be responsible for this column (Is this person Mr Hung Phan? Sorry, I am a new member, so…)
    – Secondly, the chair-man will give us a clear topic to focus on (this topic may be based on suggestions of all members here).
    – Next, we should focus on the topic which is given, not talking nonsense. For example, this topic is legal writting, and we just discuss about it.
    – Lastly, for English grammar, I think we can improve it by ourselves. By this, I mean that there is no need for us to talk about grammar here. We should focus on the purpose of this column, “English for Law”.

    Your question seems to be easy. I guess that you got it from an English translation of some Vietnamese legal material.

    You know what “Prime Minister” means. Is that right?

    Do you know “case by case basis” mean?

    This is a principle which is applied broadly in Vietnamese laws. This makes the Prime Minister become powerful. He seems to have many rights, powers and authorities, and his will seems to be laws of Vietnam. Can you guess what the principle means?

    It is “tuy tung truong hop”.

    About grammar issues, there is a book named “Understanding and Using English Grammar” with two levels (basic and advance). This book is considered as the bible of students studying abroad. It is available in many book stores , and the important thing is that it is not so expensive (56,000 VND^^). You can buy one for your reference. I believe that it will be very helpfull for you.

    Thank for your question. Honestly to say that your question is not difficult to find out the answer if your have a research. Before making any question, let have a research and make question and answer by yourself first. If you cannot find out answer and seek a help from the others, let’s share to discuss. Should not put anything you like to the others without any consideration. As a lawyer, raising a question to the other does not mean you do not have your opinions. Argument and Reasoning are the most important for law students. Law does not mean talking but argument. Therefore, could you please research and answer your question first before giving it for discussion. I will give a help to you then.

    I hope that from time to time we can share our experience and knowledge.

    About studying English, I would like to share you some. Seriously, I am not so skillful at studying languages so that my way to study English is very simple. I think English is a common living language, we can not ask why? we just ask how? Because of this I just follow what people say and what people write. Reading, listening, and writing, again and again, are my ways. Sometimes, if I can not understand some words or phrases, I try to read them three times or more, and search on Internet. For drafting, usually I rewrite at least twice.

    I think that every part of an essay should be in a tone and subject to a topic. How your tone is shall depend on specific contexts and the readers you are writing for.

    You may have your all ways but the important thing is how well we can do.

    I hope you all may share some pieces of your experience.

    We can understand briefly that: there are 3 part in an essay:
    -The first: Introductory paragraph
    -The second: Body / Development
    -The last: Concluding paragraph
    In a paragraph, also has 3 small part:
    – Introductory sentence or topic sentence
    – supporting ideas ( generally, sort sentences)
    – Concluding sentence
    And as u talk , among these paragraphs have to be coherent, unify.

    your giude is so useful:)have u ever followed the guide u give us? and what do u thinks about is?u can change all the bookguide to ur own words and may be share your experience about the reading skill.so important!
    – spend 10minutes a day to listening E ( any topic u have ) and may be u should imitiate tape speech (I mean the intonation of speech). take it easy! after a limited time u can realize that yr listening skill not bad..
    – write the lyrics of yr favourite song or write some short paragraphs about any topic can train your writing and then when u have the familiar with the writing E u can go futher than short para..

    I think that not only in legal writing but also in any essay, clear writing is always important so that I would like to provide you with some pieces of opinion as follows:

    In any job that requires communication beyond diagrams, charts, sketches, or mock-ups, you will be expected to be able to present your ideas in well-organized, readable prose that is clearly and correctly written. Whether your output is an interoffice memo, an accident report, a sales presentation, a patient history, or a legal brief, writing is the record of your activity – the evidence of the job you are doing and how well you are doing it.

    What do your readers expect?

    Readers have five unconscious expectations when they begin to read a piece of extended prose. They expect:

    1)To see paragraphs;
    2)To have the first sentence of a paragraph orient them to content of the paragraph by identifying its topic;
    3)To see paragraph units that are coherent and unified, with each one exploring a single topic;
    4)To have the paragraphs connect to each other according to some logical pattern that shows external as well as internal coherence;
    5)To be introduced, very early, to the content of the whole, preferably through the writer’s preview of the main points that are to be covered.

    • Dear all and talawas,youkhanga ! I am not very good at English but I ca explain for you about diferences betwen contract and contact. Contract is An agreement between two or more parties that is enforceable by law; a transaction between two or more people in which one or both promise to perform some duty in exchange for consideration, and if a party fails to do what he or she promised, the
      law allows the other party to seek a remedy. V. contract.
      And contact is same as the connection or alignment…The end, tawalas, criminal law not crime law…hihi

    When i read a legal paragraph, i see many synonym word, such as: principle ~ rule; comply ~ obey; pass ~ adopt ; act~ behavior ~ conduct…. So, can we use these synonyms in all situation without difference or have difference among these words in a legal document??

    I’m so greatful when clicking the title ” English for law” on the right screen but then there is not much things as I wish. May be the good things never come easy by one sticking!:)
    but As I know, contact has a lot of kind and business contact is one of the most difficult legal document to make perfect and may be, there is a lot of trap in this kind of document.However the last thing and the “bad thing” is that lawyer must creat it.:)
    is this forum set up to spread broadly the basic and standard knowledge of writing legal document skill?
    and how can I enjoin ur course?can you show me more detail about it.thanks

    As i know, contract and wills are simpler than these 2 types . because, in general, they will have form definitely. So, lawer will be easier in drafting. and, this legal document is knowed much more than these two types by student. because, in school, we don’t learn about the way to writing legal document as: inter-office memoranda , letters to clients or how to do persuade my clients? Let’s have your opinion, i looking forward yr detail response!

I am very delighted to provide you a summary about legal writing. Hopefully it would be useful for you all.

    Legal writing: An overview

    In many legal settings, specialized forms of written communication are required. In many others, writing is the medium in which a lawyer must express their analysis of an issue and seek to persuade others on their clients’ behalf. Any legal document must be concise, clear, and conform to the objective standards that have evolved in the legal profession.
    There are generally two types of legal writing. The first type requires a balanced analysis of a legal problem or issue. Examples of the first type are inter-office memoranda and letters to clients. To be effective in this form of writing, the lawyer must be sensitive to the needs, level of interest and background of the parties to whom it is addressed. A memorandum to a partner in the same firm that details definitions of basic legal concepts would be inefficient and an annoyance. In contrast, their absence from a letter to a client with no legal background could serve to confuse and complicate a simple situation.
    The second type of legal writing is persuasive. Examples of this type are appellate briefs and negotiation letters written on a clients behalf. The lawyer must persuade his or her audience without provoking a hostile response through disrespect or by wasting the recipient’s time with unnecessary information. In presenting documents to a court or administrative agency he or she must conform to the required document style.
    The drafting of legal documents, such as contracts and wills, is yet another type of legal writing. Guides are available to aid a lawyer in preparing the documents but a unique application of the “form” to the facts of the situation is often required. Poor drafting can lead to unnecessary litigation and otherwise injure the interests of a client.
